EU: Beslissing in debat "heel artikel" vs "component"

On 10 September 2015 the Court of Justice of the European Union (CJEU) settled an important debate on what should be treated as an "article" for the purposes of Articles 7(2) and 33 of the REACH Regulation. These provisions relate to certain notification and information obligations arising when substances of very high concern (SVHC) exceed the relevant threshold for an "article".
The decision will, potentially, have a far-reaching impact. Since the judgment clarifies the law as it has always been, it is important to check your compliance with your obligations under REACH when an SVHC is present in products produced in, or placed on, the EU market (Hogan Lovells, 21 september 2015).
